Spark Cycleworks Policies and Purchase Agreement Overview

IMPORTANT NOTE: These policies have been in pace since January 1st 2025. All customers must agree to these terms and policies upon checkout and completion of transaction. This can be found during the “Agree to all policies and purchase agreement overview” checkbox during checkout. By clicking this check box, customers agree to these policies.  It is the customer’s responsibility to review and acknowledge these terms and conditions.

Javelin/Brute Reutrn/Warranty Shipping Poicies



- A 1 year warranty is given on all bikes. This warranty covers all electrical and mechanical components that are damaged by means outside the customer's control. NOTE: Crashes, falls, flat tires, changes to programming with the Fardriver app, modifications to the wiring, installation of any non Spark components, over tightening components, and other actions that are the result of the customer's negligence do not constitute valid reasons for warranty claims. NOTE: Warranty claims do not constitute valid for reason for full return of bike. Warranty claims only constitute coverage of cost of replacement components. Cancellations, returns overview can be found below. Modifying the bike by means of programming controllers or physical changes voids warranty. REMINDER, THESE ARE ALL HAND BUILT BIKES CREATED ON A PER ORDER BASIS.

- A $750 fee will be charged for all cancellations placed 1) beyond 24 hours of order placement and 2) prior to shipment of the customer's completed bike.

- If a return is placed within 3 days after delivery, a 25% fee + all additional shipping costs will be charged. The remaining balance of the customer's order minus the 25% fee and minus all shipping costs, will be refunded following the delivery of all items back to Spark. This refund will be initiated within 3-5 days of the package arrival back to Spark. This policy is the result of multiple experiences in which a return was processed with a customer, their funds were refunded, then the customer did no return their product.

- No Returns are acceptable beyond 3 days (72 hours) after delivery. Reminder, warranty claims do not constitute valid reason for return. Spark's warranty program covers the cost and replacement of defective components only. Reminder: these are all hand built vehicles created on a per order basis. They can not be restocked like other off the shelf items.

- Modifications to bikes: All physical modifications and programming modifications to the Brute and Javelin are done at the customers own risk. Physical modifications to the bike's electrical system should never be done. This includes modification to the wiring harness, the battery, the motor, the controls, or any other component on the bike in which electrical current is flowing. Modifications to these systems voids all warranty and places all risk of injury on the customer. Modifications to programming without direct individual approval by our team is strictly prohibited. Modifications approved by our team include software updates on a product wide basis. Individual modifications to programming to the Fardriver controller voids all warranty and places the risk of all physical injury and damage to the bike, on the customer.


-All bikes will arrive to customers with evidence of riding as a result of Spark's extensive on road testing. We will do our best to minimize salt, dirt, and other debris, but it is likely that your bike will arrive with some form of wear and tear. Requesting a return for this reason will not be accepted. This also means your bike will arrive with an odometer reading above zero and upwards of a few hundred miles as a result of the bike's computer system requiring final calibration prior to shipping. We are unfortunately unable to reset these odometers to zero due to the nature of the screens we use and the Fardriver controller.

DAMAGE FROM SHIPPING MUST BE CLAIMED WITHIN 24 HOURS OF DELIVERY. Beyond this timeline, the customer will be responsible for filing any claims with UPS and will be responsible for paying for damaged components


- Spark is not responsible for customers' education of their local/state dmv guidelines. We do not aid in registering your vehicle or provide guidance.

- The customer is responsible for following state helmet guidelines

-All bikes are supplied with a MCO, a Bill of Sale, and a VIN. The bikes are designed to meet the 5hp federal limit for a motor driven cycle and also have a function to switch to a 2hp limit that meets most state guidelines. It is up to you to understand if our bikes meet your local requirements

- Custom build lead times are 6-8 weeks by standard for basic builds. Extensive builds may approach 10-14 weeks depending on engineering requirements and part sourcing.
- Customer's are responsible for maintaining their vehicle's operational functions. This includes routinely changing brake pads every 500 miles, tightening bolts and nuts on the bikes, maintaining proper tire pressure and wear levels, reviewing their electrical systems for corrosion and slices in cables from roadway debris. Spark will hold not responsibility for accidents and property damage from poor vehicle maintenance.


Battery Blender POlicies

1) SPARK IS NOT LIABLE FOR DAMAGES THAT OCCUR TO YOUR PEV AS A RESULT OF THE BATTERY BLENDER. THIS IS A RESULT OF OUR INABILITY TO CONTROL OTHER MANUFACTURERS’ QUALITY CONTROL AND RAMPANT MISLABELING OF PRODUCTS BY OTHER ONLINE SUPPLIERS.

2) YOUR BIKE DOES NOT HAVE THE ABILITY FOR REGEN. NOTE, EVEN IF YOU DISABLE REGEN BRAKING, YOUR BIKE MAY REGEN WHILE RIDING DOWNHILL OR COASTING. DIRECT DRIVE SHOULD BE AVOIDED! Only geared hub motors should be used.

3) YOUR BIKE DOES NOT HAVE A CONTROLLER OVER THE 30 AMP CURRENT RATING, or 35AMP IF SUFFICIENT AIR FLOW IS CALCULATED.
